New York’s law to generate funds for countering climate change is facing a legal challenge from 22 state attorneys general. The Climate Change Superfund Act was signed into law at the end of last year and would force polluters to pay into a fund to generate $75 billion over the next 25 years.The lawsuit is being led by West Virginia Attorney General J.B. McCuskey, who says New York’s law is unconstitutional and superseded by federal laws already in place.They argue New York can’t fine companies legally extracting fossil fuels, especially when done outside of the state. Legal challenges to the law were expected. Last month, state Sen. Liz Krueger, who wrote the legislation, said the law will hold up because it’s modeled after the federal superfund program and other previously upheld pollution penalties. Gov. Kathy Hochul responded to the lawsuit by simply writing on X, “bring it on.”
